Violation Description: Regulatory Notice served. The regulator has concluded that: Your Housing Group Limited (YHGL) was not compliant with the Rent Standard and between 1 April 2016 and 31 March 2020 was not compliant with the legislative requirements of the Welfare Reform and Work Act 2016 (the Act). Between 2016 and 2020, YHGL did not apply the required annual 1% rent reductions to 254 properties in five extra care schemes and to 48 general needs properties. This was due to YHGL applying the reduction to net rent (exclusive of service charges) rather than gross rent (inclusive of service charges). YHGL incorrectly set rents on re-let for 780 social rent general needs properties in 2020 and 2021. During the same period, YHGL did not cap 128 secure rent properties in line with requirements. YHGL did not set rents in accordance with the Rent Policy Statement on re-let for general needs properties on affordable rent. It did not obtain valuations on 961 affordable rent re-lets and is currently establishing whether this resulted in rent overcharges for any of these properties. At least £648,000 has been overcharged by YHGL in respect of these issues.
