Violation Description: Section 17(3)(a) of the Regulation and Inspection of Social Care (Wales) Act 2016. 1.Regulation 36(2)(d)&(e) - the service provider must ensure that staff receive core and specialist training as appropriate to their role. 2.Regulation 8(1) - the service provider must ensure that there are effective arrangements in place for monitoring, reviewing and improving the quality of care and support provided by the service. 3. Regulation 21 - the service provider must ensure that care and support is provided in a way which protects, promotes and maintains their safety and enable them to achieve the best possible wellbeing outcomes. 4. Regulation 44(3) & 4(f)7(g) - the service provider must ensure that the premises used for the provision of the service must meet the requirements of paragraph 4 of this regulation. 5. Regulation 35(1) - the service provider must not employ a person under a contract of employment to work at the service unless that person is fit to do so. 6. Regulation 26 - the service provider must provide the service in a way which ensures that individuals are safe and are protected from abuse, neglect and improper treatment. 7. Regulation 18(1) - within 7 days of the commencement of the provision of care, the service provider must: a. assess how the individuals care and support needs can best be met, b. assess how the individual can best be supported to achieve their personal outcomes, c. ascertain the individual's views, wishes and feelings, d. assess any risks to the wellbeing of the other individuals to whom care and support is provided.
