Violation Description: Section 17(3)(a) of the Regulation and Inspection of Social Care (Wales) Act 2016 (the 2016 Act). Care Inspectorate Wales are not satisfied that the action specified in the Improvement Notice has been taken within the time limit specified. Section 15(1)(c) of the 2016 Act. There is no responsible individual designated in respect of each place at, from or in relation to which the provider provides a regulated service (and the time limit for applying to vary the registration prescribed in regulations made under section 11(2) has expired). 1. Regulation 73 (1) (b) because the RI does not have arrangements in place to meet staff in the service 2. Regulation 76 76 (1) (a) (b) (d) (e) because the RI does not have arrangements in place to engage with individuals and others. 3. Regulation 74 (1) (2) because the RI does not report to the service provider on the adequacy of the resources available to provide the service. 4. Regulation 80 (1) (3) (a) (b) (c) (d) 4 (a) (b) because the RI does not have arrangements in place to establish and maintain a system for monitoring, reviewing and improving the quality of care and support provided by the service. 5. Regulation 6 because the RI does not have clear arrangements for the oversight and governance of the service in order to establish, develop and embed a culture which ensures the best possible outcomes are achieved for individuals using the service and to meet the requirements of the Regulations.
