Violation Description: IP employed as a Picker was going about his duties as a yard operative and was working in the nearby vicinity of the 350 Fuchs grab machine. The grab operative had a brush in the grab jaws; this is used to sweep the detritus back into the pile. He had completed his task and looked for a place to put the brush down. The driver swung the arm to the location of the pickers and dropped the brush, in doing this the brush fell onto the I.P striking him on the back and causing him to hit the floor with force causing injuries to his face and head. IP suffered fractured skull. Fractured eye-socket and fractured cheek bone
